Fidelity Bank Vs 12 ex-Staff: Court Reserves Judgement Amidst Drama

The 12 ex-staff of Fidelity Bank’s protracted legal tussle against their employer, Fidelity Bank Plc is due for judgement in October.

The 12 aggrieved ex-staff approached the Nigerian Industrial Court, Lagos to seek legal redress on their retirement benefits they said the bank refused to pay.

This, according to their complaints was after they have reached their retirement age and have served the number of years required by the bank for retirement but were denied payment.

SOJ WORLDWIDE Online News eyewitness filed in the proceedings of the court on Thursday as follows;

“At the court today, it was expected that judgement would have taken place, but prior before today, Fidelity made a plea that all staff should be docked to show proof of their status, but before then Esobe Obasi was to be docked, after which Fidelity witnesses will be docked.

Fidelity came with three of their witness but was not allowed.

Fidelity witness – Dan Okoye, (HR); Mike Nwachukwu ( HR); Henshaw( Legal).

They raised a proposal that three witnesses from the claimant is not enough to make decisions for all the retired staff, they prefer them to all individually be docked, this is to affirm injustice, in which the judge also was in agreement.

This was adjourned to October …but on announcement of the date, one of the retired staff, got up angrily and left the courtroom by hissing, so the judge requested that they call the staff back, and the judge said,  “can you give me reason why you hissed”, and that can make her to punish him, the staff – Sylvester Abiamuwe, started crying, the judge said, “if you cry”….but he had to control himself.

Sylvester said that His children have stopped going to school, things are difficult that this case has been on for 3  years, the judge said I have to do the right thing so that nobody will accuse her of not doing the right thing, that justice must prevail.

The judge now had to pardon the staff, and never allow such to repeat itself. The staff pleaded sorry and kept apologising.

The case came to a close today, the judge admonished everyone present in the court.

We had other Fidelity staff, about nine of them in attendance that were asked to go, without pay too, they came in solidarity with us.”

According to the Judge of the Nigerian Industrial Court (NIC), the actual date of judgement in October 2019 will be sent to the parties involved in the dispute.
