PART 3 SCENE 2: Kogi State Chief Judge Orders Melaye Moved To Abuja

The Kogi State Chief Judge, Justice Nasir Ajanah has ordered the movement of Senator Dino Melaye to the National Hospital Abuja.

The Chief Judge gave the order, at the High Court Lokoja, when Counsel to Senator Melaye filed processes for motion seeking the bail of the Senator who is standing trail for Conspiracy and Gun running among other charges brought against him.
The Interim order the Chief Judge explained is to enable the senator receive medical attention, following the lack of facilities at the Police Clinic Lokoja where he is been held in police custody.
The Chief Judge disclosed that the interim order became necessary as the prosecution could not proffer a federal prison in Abuja that has the required health facilities that will take care of the health condition of Senator Melaye.

The Chief Judge described the case as one that present an interesting scenario, ordered the Commissioner of police to be served through his counsel in court, be allowed to make a variation on his motion, while the Senator be taken to National Hospital Abuja, still under the custody of the Police.
In his submission for bail, Mike Ozekhome, counsel to Sen. Melaye prayed the court for a speedy trial of the matter, said because of the critical health condition of his client, requested for his client to be transfered to the National Hospital Abuja for proper medical care, before the next Adjoined date.

Ozekhome, through a consolidated motion, added that only the living stands trial, urged the prosecution counsel to heed to the request to save the life of his client.
Earlier the Prosecution Counsel, Alex Iziyon SAN, represented by I.E Otome, said they are not objecting to the consolidated motion, made a variation on his application to allow Senator Melaye, be taken to National Hospital Abuja.
The Chief Judge adjourned the case to Monday the 7th day of May, for parties to argue for the Bail condition of Senator Melaye.
